Cue Card

Terms of Service

Last updated: October 21, 2026

Beta. Cue Card is in beta. These terms apply during the beta and may change as the service grows. We'll notify theater administrators by email of significant changes.

1. Agreement

These terms are an agreement between Kyle Levien, doing business as Cue Card ("we", "us"), and the theater or organization that creates a Cue Card account ("you"), and apply to anyone using Cue Card on its behalf. By creating an account or using the service, you agree to them. If you accept for an organization, you confirm you have authority to bind it. Audience members who simply read captions are not account holders, but use of the service is still subject to these terms and our Privacy Policy.

2. The service

Cue Card lets a theater post captions for a performance and lets audience members read them on their own devices, with tools for managing shows, scripts and team members. We may change, add or remove features. Some features described on our website are planned and not yet available.

3. Accounts and people

4. Your content

"Your content" means the scripts, captions, logos, show details and other material you upload or post. You keep ownership of it. You give us permission to host, store, process and transmit it as needed to run the service for you and your audience. You confirm that you have the rights to use your content this way, including any rights needed to display the text of the works you caption, and that it does not infringe anyone's rights or break the law.

5. Acceptable use

Don't use Cue Card to: break the law or others' rights; send unlawful, harassing or deceptive content to an audience; attempt to access other theaters' data or our systems without permission; disrupt or overload the service, or work around its limits; or resell the service without our written permission.

6. Your responsibilities to your audience

You run your performances and decide what captions appear. Cue Card is a tool to help make performances more accessible, but we cannot guarantee that captions will always be accurate, timely or available. You remain responsible for meeting any accessibility or accommodation obligations that apply to your venue and productions, and for having a plan if the service is unavailable during a show.

7. Availability and changes

We work to keep Cue Card running, but it is provided as available, and during any beta or free period we make no uptime commitment. We may perform maintenance or make changes that cause interruptions.

8. Fees

Cue Card is free while in beta. If we introduce paid plans, we'll tell theater administrators in advance, and you won't be charged without agreeing to a price first.

9. Suspension and ending

You can stop using Cue Card, and ask us to delete your theater, at any time by contacting support@cuecard.cc. We may suspend or end access to an account, with notice where reasonable, if it breaks these terms, puts the service or others at risk, or we are required to by law. We may also suspend a theater for a short time while we look into a problem. On deletion, we remove your data as described in the Privacy Policy.

10. Our property

We own the Cue Card service, software, name and branding. These terms give you a limited right to use the service; they don't transfer any of our rights to you. If you give us feedback, we may use it without obligation to you.

11. Disclaimers

To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

12. Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, and our total liability for any claim relating to the service is limited to the greater of US$100 or the fees you paid us in the previous 12 months. Nothing in these terms limits liability that cannot lawfully be limited.

13. Changes to these terms

We may update these terms. We'll change the date above, and for significant changes we'll notify theater administrators by email. If you keep using the service after a change takes effect, you accept the updated terms.

14. Transfer

We may transfer these terms and the service to another person or organization, for example if we form a company, merge, or sell the business. We'll tell theater administrators by email when that happens, and the transferee will take on our obligations under these terms. You may not transfer your account or these terms to anyone else without our written consent.

15. Governing law and disputes

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. You and we agree that any dispute about them or the service will be brought in the state or federal courts located in Washington State.
